Terms of Use

You must be at least 13 years old (or the age of digital consent in your country) and able to form a binding contract. If you use FaceMatch on behalf of an organization, you represent that you have authority to bind that organization.

FaceMatch provides tools to search for visually similar faces and images, monitor appearances, manage a private photo library, and request opt-out removals from our index. Results are possible matches only and may be incomplete, incorrect, or outdated. FaceMatch is not a law-enforcement identity system and does not guarantee identification of any person.

You agree not to:

• Use the Service to stalk, harass, threaten, defraud, or unlawfully dox anyone.
• Upload or search photos you do not have the right to use, including photos of others without a lawful basis.
• Attempt to re-identify people in ways that violate privacy, publicity, or data-protection laws.
• Scrape, reverse engineer, overload, or disrupt the Service.
• Bypass rate limits, access controls, or security measures.
• Use FaceMatch for unlawful discrimination or other illegal purposes.

We may suspend or terminate accounts that violate these Terms or create risk to users or the public.

You are responsible for your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access. We may refuse registration or reclaim usernames as needed to protect the Service.

You retain ownership of photos and content you upload. You grant FaceMatch a limited license to process that content solely to operate the features you use (for example, running a search, storing library items you save, or generating alerts).

Query photos are processed for search and discarded by default. Library and contribution features may store content you explicitly save or contribute.

Our search index may include opt-in sources and publicly discoverable material subject to our crawler and moderation practices. You may request removal of specific URLs or domains through our Opt-Out process. We will make good-faith efforts to process valid requests, but removal may not be instantaneous and does not control copies hosted by third parties.

Paid plans, trials, and billing terms are described on our Plans page and at checkout. Fees are generally non-refundable except where required by law or expressly stated. Taxes may apply. Failure to pay may result in suspension of paid features.

The Service may integrate with third parties (for example payment processors or optional photo providers). Their terms and privacy policies apply to your use of those services. FaceMatch is not responsible for third-party sites or outages outside our reasonable control.

FaceMatch, including its software, branding, and design, is owned by us or our licensors. These Terms do not grant you any right to copy, modify, or commercially exploit our trademarks or software except as needed to use the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF MATCHES, AND NON-INFRINGEMENT. We do not warrant that results will be complete, correct, or suitable for any legal, employment, or safety decision.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACEMATCH AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU HAVE NOT PAID US.

You agree to defend and indemnify FaceMatch against claims arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or end access if you breach these Terms, create risk, or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

We may update these Terms from time to time. Continued use after the updated Terms are posted constitutes acceptance, except where additional consent is required by law.

These Terms are governed by the laws of the State of California, USA, excluding conflict of law rules, unless mandatory consumer protections in your country require otherwise. Courts in California will have exclusive jurisdiction for disputes that are not subject to another mandatory venue.
